In Queensland, the primary laws governing drug offences are found in the Drugs Misuse Act 1986 and the Drugs Misuse Regulation 1987. These pieces of legislation cover a range of drug-related offences, from minor infringements leading to fines to serious crimes warranting imprisonment.

Regarded as one of the most severe offences in Queensland law, next to murder, trafficking involves the illegal operation of a business that deals in the sale of dangerous drugs. The scope of such a business can vary greatly, from small-scale operations to large, multimillion-dollar enterprises. Notably, regular sale of drugs to fund personal addiction can also be deemed as trafficking. The harshest penalty for this offence can extend to 25 years’ imprisonment.
Supplying Dangerous Drugs
The act of supplying dangerous drugs extends beyond mere sale and includes actions such as sharing, passing, or giving drugs to another person. For example, sharing a cannabis joint amongst friends could fall under this offence. The maximum sentence for supplying drugs can reach up to 25 years in prison, especially when the drugs are supplied to minors or to individuals in correctional facilities.
Possession of Dangerous Drugs
Possession charges necessitate proving ‘knowledge and control’ over the drug. If drugs are found on a person’s property or in their vehicle, the law may presume control, thus implying possession, unless evidence to the contrary is provided. The most severe penalty for possession of dangerous drugs can also be up to 25 years in prison.
